An past “American Idol” contestant is suing the producers of the singing show after he claims he suffered major ear damage when an audiologist’s representative took our his earpiece and part of his eardrum was removed.
Michael Simeon Smith is claiming that on December 12, 2014, he was preparing to perform on the show and was fitted for an earpiece in his right ear, along with a silicone or holding material.
According to the lawsuit, he “immediately felt pain,” and when the audiologist’s representative pulled it out, a portion of his eardrum was removed. He was then moved to a different room, as blood came out of his ear.
“Plantiff has sought medical treatment for his injuries, including right tympanoplasty,” his lawsuit stated. “Plaintiff has been unable to perform music at the same level as prior to the incident, due to the absence of much of his eardrum.”
The claim includes negligence and product liability, but doesn’t appear to seek any specific damages.
Fox Broadcasting Co. is named as the defendant, along with the production companies behind the show and the audiologist representative. Fox has not made any comment.
